Introductory Provisions
For the purposes of these Operating Regulations, the terms used shall be interpreted as they are defined in the General Terms and Conditions for the Provision of Services in GOLEM CLUB's Sports and Fitness Facilities (hereinafter referred to as the "GTC"), with which these Operating Regulations form an integral part of the terms and conditions for the use of the Services provided by the Clients.
1. Identification details of the facility’s Operator
PREMIUM FIT, s.r.o. with registered office at Einsteinova 18, 851 01 Bratislava, ID No: 35 817 721, registered in the Commercial Register of the City Court III, Section Sro, Entry No. 24671/B.
2. Type and Manner of Provision of the Services, Prohibited Acts in the Provision of the Services
2.1 The Operator provides Services related to a healthy lifestyle, in particular Gym Services, fitness, cardio zones, group exercises, and other Services. In the event that Services are provided by the Operator on the premises, which are subject to special conditions to be contained in the Operating Regulations, these are listed in Annex No. 1 of these Operating Regulations (massages). The manner of provision of Services means enabling the Clients to use selected Services of the Operator at the Facility or to use its Services in accordance with the terms and conditions set out in the Price List, in these Operating Regulations, and in the GTC.
3. Operating Conditions and Health Protection Policy for Clients and Employees
3.1 The terms and conditions of access to the Facility and the provision of the Services are set out in clause 6 of the GTC.
3.2 The Facility’s layout is divided as follows: reception, fitness, cardio, performance zone, aerobics hall, indoor hall, massage room, sanitary facilities, showers, changing rooms.
3.3 When exceeding the capacity of individual parts of the Facility, the Operator is entitled not to allow the Client to enter until the capacity of the Facility allows it. In this regard, the Client shall not have any claims against the Operator.
3.4 If the Client fails to demonstrate the possibility of using the Services in the manner required by the Facility, the Client shall not be entitled to enter the Facility.
3.5 The Client is obliged to use all equipment and devices in the Facility only in the manner for which they are intended. In case of any doubts about the correctness of their use, the Client shall refrain from using them or ask the person in charge of the Operator about the possibilities of using a particular device or part of equipment.
3.6 The Operator shall not be liable for injuries and accidents caused by the Client to him/herself or to another person by his/her own carelessness or failure to comply with the Operating Regulations.
3.7 Clients use all Services in the Facility at their own risk.
4. Instructions, Restrictions, and Prohibitions Regarding Clients
4.1 The Client is obliged to behave in such a way as not to interfere with the comfort of other Clients, to avoid damage to health and property and not to interfere in any way with the operation of the Facility and the use of the Services by other Clients by his/her actions.
4.2 The Operator shall not be liable for damage to items brought in or left in the premises during the use of the Services, if these are left outside the places reserved by the Operator. If during the use of the Services the Client places items in the places reserved by the Operator, which individually or in the sum of two or more items exceed the value of EUR 100 (valuable item), he/she is obliged to notify the Operator’s responsible person and place them in the safe deposit box, otherwise the Operator is not liable for any damage, theft, devaluation exceeding the given amount. The liability for damage of the Operator is further regulated in the GTC.
4.3 For the storage of items brought in or left in the Facility during the use of the Services (not valuables), there are numbered lockers in the changing rooms, which the Client is obliged to secure with a lock. The Client has the possibility to borrow a lock from the Operator for a fee specified in the Price List.
4.4 The Client is obliged to empty the locker in the changing room upon departure and leave it unlocked in the case of using the safe for valuables. The Operator has the right to open the lockers in the changing room and the safe deposit box which remain locked after the operating hours. The Operator shall not be liable for any damage or loss caused by a breach of the obligation to leave the locker or the safe deposit box empty and unlocked. The Operator is obliged to store items found in an open locker for 30 days after the discovery. When handing over the items, the Operator shall charge the Client a handling fee in accordance with the current Price List unless otherwise agreed. Upon receipt of the items from the Operator, the Client is obliged to hand over a signed affidavit stating that he/she has actually received the items.
4.5 Loss, theft or damage to the key/chip/Golem card is charged according to the applicable Price List. At the same time, the Client is responsible for the key/chip received at the reception desk during the entire use of the Services he/she has chosen to use.
4.6 The Client is not entitled to make any claims against the Operator due to announced restrictions on the operation of the Centre (sports, social or other events) as long as he/she has been informed of them upon entry.
4.7 The Operator reserves the right to interrupt or restrict the operation of the Centre in justified cases. This applies in particular to the rental of part or all of the Facility as well as necessary repairs and maintenance that are not incompatible with the maintenance of normal and comfortable and safe operation for the members, as well as in a situation caused by force majeure (e.g. water pipe failures, shutdown of water, electricity or hot water supply, forced closure of the Facility due to a decision of the landlord or a state or municipal authority, power outage, flooding, etc.). In this case, the Client shall not be entitled to compensation.
4.8 The Client is obliged to follow all guidelines and instructions of the Operator during the entire period of the visit to the Centre.
4.9 Glasses of water or other beverages are not allowed to be distributed around the Centre premises.
4.10 The following are prohibited from entering the Premises:
a) Persons under the apparent influence of alcohol or toxic substances. The judgement is the sole responsibility of the Operator or the Operator's responsible person
b) Persons with animals
c) Persons showing obvious signs of transferable, infectious diseases (assessment is the sole responsibility of the Operator, the Operator's responsible person, or a person authorised by the Operator) or persons with open wounds or skin problems or suffering from any disease, if the Operator or the Operator's responsible person assesses that such a person's stay in the Facility could cause a threat to the health of other Clients or damage to the Operator's property
d) Persons who intend to use the Facility for any purpose other than that for which they are intended (for example, commercial or non-sporting use) without the permission of the Operator, the responsible person, or a person authorised by the Operator
e) Persons who fail to comply with the obligations set out in the GTC or these Operating Regulations
f) Persons using the Services wearing dirty or smelly clothing (the assessment is the sole responsibility of the Operator, the responsible person, or a person authorised by the Operator)
4.11 For safety reasons, persons who cannot move or dress or undress independently without the assistance of another person, as well as persons with significant physical or mental disabilities, are permitted to enter the changing room accompanied by another person who is competent to perform the aforementioned actions.
4.12 In particular, it is forbidden to:
a) Smoking
b) Bringing in and using glass objects (including bottles)
c) Photographing or filming persons or groups without their consent. Photography or filming for commercial purposes and for the press requires written permission from the Operator
d) Make excessive noise and restrict the comfort of other Clients by one’s own behaviour
e) Use sporting and playing equipment
f) Use of drugstore products outside the showers
g) Consume (anything)
i) Interfering with the technical equipment of the Facility
j) Jumping over the turnstiles
k) Request services from the Operator which are not listed in the Price List or which are contrary to the purpose of the Services or the Operating Regulations
l) Carrying and using weapons
m) Leave bags, rucksacks, and other items in open areas of the fitness centre, such as the exercise area and aerobics halls
n) Use of the aerobics hall outside of group exercise classes or during individual rental hours
4.13 In particular, the Client obliged to:
- observe cleanliness and hygiene in the premises of the Facility, also in case of any deficiency to inform the Operator or the Operator’s responsible person,
- immediately inform the Operator or the Operator’s responsible person in case of sudden deterioration of health, if he/she notices any health problems of him/herself or other Clients
- to treat the equipment of the Facility with care and not to damage the premises and property of the Operator or third parties,
- use clean and appropriate sports footwear and sports clothing,
- comply with the Operator's instructions,
- after the end of the exercise, store the used equipment in the place designated for it (do not take the equipment outside the designated areas),
- use a towel when exercising in the premises of the Facility
- clean machines and equipment after use
- store personal belongings (bags, rucksacks) in a locker in the changing room
4.14 In the event of non-compliance with the Client's obligations set out in the GTC or the obligations set out in these Operating Regulations, the Operator, through the responsible person or the trainer on duty, may proceed in accordance with the GTC, as well as request the Client to leave the premises immediately without any compensation to the Operator.
4.15 The Client who is interested in personal training with the Trainer may ask the Operator’s responsible person for contact or recommendation.
4.16 The External Trainer is required to pay the External Trainer Fee as per the Operator's Price List in force at the time of each admission. The Operator may require the Client to pay the External Trainer Fee in accordance with the applicable Price List in the event that the Operator's responsible person determines that the Client (External Trainer) is visibly guiding (training) another person without being registered with the Operator as a Trainer or an External Trainer who pays the External Trainer Fee with the Operator. The External Trainer Fee includes the External Trainer's personal training sessions as well as the External Trainer's inputs during the training of the External Trainer's Clients. The External Trainer may not address Clients at the Centres during their visit to the Operator's Centres.
4.17 The Clients are obliged to use the exercise equipment, fitness machines, and other equipment of the Centre only in the manner intended for that purpose. They are obliged to behave in such a way as not to damage them or endanger their own health or the health of other Clients. The Operator shall not be liable for injuries and accidents caused by the Client's own carelessness, disregard of his/her own health condition and disregard of the operating rules.
4.18 The Client participates in the exercise at the Operator's Centre at his/her own risk, is physically and mentally healthy, and is able to complete the exercise. Before each exercise, he/she shall consider his/her current state of health and adapt the type of exercise, intensity, load, and duration of the exercise accordingly.
5. Method and Frequency of Cleaning of the Facility
5.1 Cleaning of the Centre's premises shall be carried out daily prior to the start of operations and on an ongoing basis as required. Cleaning of personal hygiene facilities, surfaces, and floors shall be carried out throughout the day as required. Waste bins located in the Facility are emptied as needed.
6. Procedure for Mechanical Cleaning or Disinfection of Room Surfaces and Furnishings
6.1 Disinfection, cleaning, tidying, as well as all cleanliness and tidiness activities in the entire Facility are the responsibility of an external company, which carries out this activity on the basis of a contractual relationship with the Operator.
6.2 The rolls (disposable paper towels) placed in the premises of the Facility are intended for wiping the machines after their use, not for personal hygiene.
7. Method and Frequency of Cleaning of Lights and Windows
7.1 Lights and windows shall be protected from breakage by a sufficient distance and shall be cleaned as necessary, but at least once a year.
The Operating Regulations are valid from 1 January 2021
Annex No. 1 - supplement to the operating regulations in relation to the provision of selected services in accordance with the Decree of the Ministry of Health of the Slovak Republic No. 554/2007 Coll.
1) Type and method of provision of services, health contraindications of services, and prohibited acts in the provision of services,
Clients will be provided with massage services in accordance with the valid Price List according to the types of massages offered in individual Facilities.
Health contraindications on the part of the Client
· heart weakness
· people with a cardiac pacemaker
· all bleeding conditions
· all febrile illnesses
· pregnancy, breastfeeding
· Infectious skin diseases
· varicose veins (varices)
· high blood pressure
· people with metal transplants
Health contraindications on the part of the masseur
· transferable skin diseases
· infectious diseases of the respiratory tract
· acute medical conditions
Prohibited acts in the provision of services:
· manipulation of scars
· manipulation of birthmarks
· procedures on the cornea and conjunctiva of the eye
2) Operating Conditions and Client Health and Safety Policy and the Occupational Health and Safety Policy of the Facility's employees,
In the Facility’s premises, we comply with hygiene and anti-epidemic regulations and measures. Compliance with these is the responsibility of the Operator, who ensures that the hygiene in the Facility is properly maintained. In particular, he/she shall ensure measures to prevent the occurrence and spread of transferable diseases.
The Facility must be kept clean and tidy. The staff must take care to observe personal hygiene. They shall be provided with a towel and soap.
Staff serving customers shall take care to observe personal hygiene, namely:
- have clean working clothes
- wash their hands with their own soap under running water every time they have finished serving a customer, and have their own towel.
The Facility shall be equipped with sufficient cleaning and disinfecting agents.
There is a first-aid kit in a suitable and accessible place in the Facility, equipped in accordance with Decree No. 554/2007 of the Ministry of Health of the Slovak Republic on details of requirements for human body care facilities.
In the event of injury to the masseur or the Client, or in the event of bleeding of the Client in connection with the performance of the Service, the affected area shall be immediately rinsed with water and subsequently disinfected. In case of contamination of the hands with biological material, the hands must be washed and disinfected with a product with bactericidal and virucidal effect (cutasept).
The Facility shall be equipped with sufficient cleaning and disinfecting equipment and clean linen or disposable equipment.
It is only allowed to use cosmetic products from the distribution network that are not harmful to health.
3) Instructions for Use of the Equipment
If any equipment is used in the provision of the Services, both the Staff and the Client are obliged to follow these instructions for use. Instructions for the use of the equipment are available in the Facility. Medical contraindications to the use of these equipment will be stated in or attached to the Instructions for Use.
4) Procedure for mechanical cleaning, disinfection and sterilization of work tools and devices, including room surfaces and equipment,
Wet mechanical cleaning and disinfection of work surfaces, floors and personal hygiene equipment shall be carried out daily after the end of the operation (from 10 p.m. to 6 a.m.) and continuously during the performance of the work.
Equipment surfaces in direct contact with the Client's body must be washed and disinfected after each Client with a product designed for this purpose.
Damp mechanical cleaning of washable wall surfaces and furniture must be performed weekly.
When using disinfectant, follow the manufacturer's instructions provided and adhere to expiration dates. If waste is generated when servicing a Client, it is removed after each Client and collected in lockable containers. Waste bins are emptied, cleaned, and disinfected daily.
Basic repair of all equipment paintwork and painting must be carried out at least once every two years
Disinfectants used in the Facility:
Surface disinfectants: pantra, cleamen, crystal
Disinfectants for work tools: peresal
5) Method of Storage and Handling of Linen
There must be a sufficient quantity of linen in the facility, appropriate to the expected number of Clients. Clean linen must be used for each Client.
Clean linen and used linen must not come into contact with each other or be interchanged during the handling of the linen.
Clean linen is stored in sufficient quantity in a lockable locker, used linen is put in a plastic closable basket, from which it is taken daily for washing. There are no designated areas for drying laundry in the Facility, so this activity is not carried out. Laundry is done in the laundry room. Clean linen is carried in disposable plastic bags.
6) Method and Frequency of Cleaning of the Facility
The Facility is kept clean and tidy. Disinfection of walls, floors, and equipment is carried out regularly - daily. Disinfectants available from the distribution network are used. When using them, it is necessary to follow the working procedure specified in the manufacturer's instructions.
Municipal solid waste (MSW) shall be collected in sealable and washable containers and removed daily. The containers shall be cleaned and disinfected daily. The collection of MSW is provided by AUPARK Shopping Center Bratislava.
7) The method of waste management, its disposal, the frequency of emptying the waste bins, their cleaning, and disinfection.
Municipal solid waste (MSW) shall be collected in sealable and washable containers and removed daily, the containers shall be cleaned and disinfected daily.
Wastewater is discharged into the public sewer.
